Unrepresented doctors face severe sanctions at tribunal hearings

20 December 2023

According to Medical Protection, nearly 37% of overseas-trained doctors faced Medical Practitioners Tribunals without legal representation. This lack of legal support significantly increases the likelihood of severe penalties, such as suspension or erasure from the medical register. Unrepresented doctors are 83% more likely to receive harsh sanctions. In contrast, those with legal representation achieve much better outcomes. In fact, only 55% of doctors with legal support face suspension or erasure, while 27% walk away without impairment findings. This data clearly shows the critical importance of securing proper legal support during these challenging proceedings.

Jake Herman from Regulatory Defence has seen firsthand the significant impact tribunal proceedings have on healthcare professionals. His experience at the General Medical Council (GMC) gave him a clear understanding of how overwhelming and stressful investigations can be, particularly for doctors without proper representation. The mental, physical, and reputational toll on healthcare professionals during these times can be severe. Without expert legal advice, doctors remain vulnerable to more serious consequences, reinforcing the importance of obtaining legal guidance.

At Regulatory Defence, the team offers both expert legal advice and comprehensive support throughout the investigation process. This approach ensures that healthcare professionals receive full support from start to finish, reducing the stress and uncertainty often associated with tribunal proceedings. Their combined legal and emotional support helps improve the chances of achieving a favourable outcome.

We strongly urge all doctors, especially those trained overseas, to seek timely advice from their indemnifier or a legal representative if they face investigation. Legal representation can be the key difference between minor consequences and career-altering sanctions. The right support is crucial to ensuring a fair and just outcome in these proceedings.
